1. Eligibility: Sweepstakes open to legal residents of the fifty (50) United States and the District of Columbia who are U.S. licensed drivers 21 years of age or older as of date of Sweepstakes entry. Employees of Levi Strauss & Co., Sears Department Stores, Toyota Motor Sales, USA Inc., and 206, Inc. (collectively, the “Sweepstakes Entities”) and each of their respective subsidiaries, affiliates, divisions, advertising and promotion agencies, individuals engaged in the development, production or distribution of materials for this Sweepstakes and the immediate families of each, or persons domiciled in the same household of such employees are not eligible. Sweepstakes is governed by U.S. law and is subject to all federal, state and local laws. By entering the Sweepstakes, participant agrees to be bound by these Official Sweepstakes Rules and the decisions of judges, administrators and Sponsor, which shall be final in all respects. Sweepstakes Entities, and each of their respective affiliates, divisions, subsidiaries, and all coordinating agencies shall not have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with the prize provided pursuant to the Sweepstakes and/or any person’s participation in the Sweepstakes provided however, that Toyota Motor Sales, USA, Inc. (“TMS”) shall be solely responsible for any express written limited warranties specifically set forth in the applicable Owner's Guide for the Prize Vehicle.
2. How To Enter: Find “Win a Toyota® Prius® From Dockers® At Sears Department Stores” Entry Forms at Sears Department Store point-of-sale posters from June 7, 2008 through June 15, 2008 (the “Promotion Period”), or while supplies last, whichever occurs first. Sponsor is not responsible for missing Entry Forms or the exhaustion of Entry Form supply during the Promotion Period at retail locations. The Entry Form also serves as a gas card premium item offer redemption form, but Sweepstakes participants may enter the Sweepstakes without taking advantage of the premium item offer. To enter, fill out the Entry Form in its entirety (which includes name, address, phone number and email) – check the “opt-in” Entry Form box to indicate your desire to enter the Sweepstakes - and mail it to Dockers Gas Card Offer & Hybrid Car Sweepstakes, PO Box 1083, Grand Rapids, MN 55745-1083. Alternatively, you may download the Sweepstakes Entry Form at www.206inc.com/dockersgiftcard2008 during the Promotion Period and mail the Entry Form to the address listed above. Entries must be postmarked by no later than June 28, 2008. Sponsor is not responsible for any lost, late, illegible, misdirected, postage-due or mutilated entries. Limit of one (1) Sweepstakes entry per household address. All materials and information submitted becomes the property of the Sponsor and will not be returned
3. Prize, Approximate Retail Value and Conditions: (1) Grand Prize: A 2008 Model Year Toyota® Prius®, Touring Package #6, with a manufacturer’s suggested retail price of $28,200.00 (“Prize Vehicle”). The winner must personally retrieve the Prize Vehicle within thirty (30) days of written notification of delivery and must present adequate personal identification and evidence of legally required insurance (or an alternative winner shall be selected and the original winner’s rights to the Prize Vehicle shall be automatically forfeited). The winner shall be responsible for all taxes, license, title and registration fees or other costs, including without limitation any travel or transportation costs, associated with transferring and/or winning of the Prize Vehicle (provided, however, the Prize Vehicle shall be delivered at no cost to the winner at an authorized Toyota dealer or distributor in the U.S. reasonably close in proximity to the winner's residence). The depiction of the Prize Vehicle in any advertising or promotional materials or physical display may not reflect the actual vehicle delivered to the winner. TMS, Sponsor or Administrator shall not be responsible for delays in delivery of the Prize Vehicle, and delivery is subject to availability. TMS, however, shall use all reasonable efforts, subject to availability, to deliver the Prize Vehicle within 180 days after receipt of prize claim paperwork (see Rule #4). The winner shall bear all risk of loss or damage to the Prize Vehicle after it has been delivered to the specified delivery site. The Prize Vehicle will be delivered solely with the express written limited warranties set forth in the Prize Vehicle’s applicable Owner's Guide, which warranties shall run for the term set forth in said Guide. Prize Vehicle cannot be assigned or transferred. No prize substitution is allowed, except that Sponsor reserves the right to substitute a prize or equal or greater value, in the event that the Grand Prize becomes unavailable. Approximate retail value of the Grand Prize is $28,200.00.
4. Random Drawing & Certain Restrictions: On or about August 1, 2008, a random drawing will be conducted by Cottonwood Enterprises, Inc. – an independent judging organization - from among all valid entries received by the entry deadline. Odds of winning a prize depend upon the number of valid entries received. Many will enter, only one (1) entrant will win a prize. All prizes will be awarded. Decisions of the judges shall be final and binding in all respects. Potential prize winner will be notified by certified mail on or about August 15, 2008. Potential prize winner will be required to sign an Affidavit of Eligibility/Release of Liability/Publicity and Advertising Consent and Release (except where prohibited by law) and such other documents reasonably required by Sponsor. Acceptance of a prize constitutes permission for Sweepstakes Entities and/or their designees to use the winner’s name, address, photograph, testimonial or other likeness and/or prize information or personal exposition (and/or any edited portion thereof) for promotional, advertising and/or publicity purposes in any media, now or hereafter known throughout the world in perpetuity, without compensation or notice to, or further consent of, to the winner to the extent permitted by law. All such documents must be signed and returned within fourteen (14) days of notification or prize will be forfeited. Return of any prize notification as undeliverable will result in disqualification. All potential winners are subject to verification before any prize will be awarded. In the event that any potential winner is disqualified for any reason, an alternate winner will be selected in a random drawing from all eligible entries received during the Promotion Period. The Sweepstakes participant is solely responsible for entering the Sweepstakes during the Promotion Period and properly claiming a prize if selected as a winner. The reporting and payment of any tax liabilities (Federal. State and Local) incurred by the winner as a result of this Sweepstakes and any prizes won are the sole responsibility of the winner. Sponsor is not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections, or incomplete or garbled computer transmissions that might limit a consumer's ability to access or download an Entry Form to participate in the Sweepstakes. No correspondence or other inquiries regarding entries will be accepted.
5. General Conditions: Sponsor or Administrator reserve the right to cancel or modify the Sweepstakes if fraud, technical failures or any other factor beyond their reasonable control impairs the integrity of the Sweepstakes, as determined by Sponsor or Administrator in its sole discretion. In such event, Sponsor or Administrator reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor or Administrator reserve the right, in its sole discretion, to disqualify any individual they find to be tampering with the entry process or the operation of this Sweepstakes or to be acting in violation of these Official Sweepstakes Rules or any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage Sweepstakes Entities’ web site or undermine the legitimate operation of this Sweepstakes may be a violation of criminal and civil laws and, should such an attempt be made, Sweepstakes Entities reserve the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s or Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
6. Disputes: Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts in the city and county of San Francisco, CA; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Sweepstakes Rules, or the rights and obligations of the entrant, Sponsor and Administrator in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

Data Collection: By submitting this form, you consent to collection, use, and disclosure of the information contained in it by Levi Strauss & Co., together with any information you may subsequently provide to Levi Strauss & Co., or to any third party, solely for the purposes of processing this form, fulfillment of the Sweepstakes and responding to your requests about the Sweepstakes.
8. Winner’s List: For a list of winners, send a stamped, self-addressed envelope to “Dockers Prius Sweepstakes Winner’s List Request”, PO Box 11508, Bozeman, MT 59719-1508 to be received by October 31, 2008.
